Quotes
Social welfare theory solves the conundrum of mercy's relationship to justice because it denies that either justice or mercy is an independent good; indeed, it denies the possibility of moral theory altogether, except perhaps as a useful proxy or shorthand for the workings of the calculus of social welfare. Clearly, this theory, in its exclusive form, faces a daunting challenge from our deep-seated moral intuitions and thousands of years of human history, not to mention institutional challenges in the feasibility of performing a plausible calculus of social welfare within the structures of the criminal justice system.
