A regional election was held in the Basque Country on 1 March 2009 to elect the 9th Parliament of the autonomous community. All 75 seats in the Parliament were up for election. It was held concurrently with a regional election in Galicia. It would be the first time that the elections for two of the Spanish "historical regions"—namely, those comprising Andalusia, Catalonia, Galicia and the Basque Country itself—were held simultaneously.3 January 2009 Ibarretxe solapa las elecciones vascas con las gallegas para debilitar a sus rivales https://elpais.com/diario/2009/01/03/espana/1230937201_850215.html es El País 14 February 2020 This would evolve into an unwritten convention in subsequent years, with Basque and Galician elections being held concurrently in 2012, 2016 and 2020.10 February 2020 Feijóo lanza un adelanto electoral de alto riesgo frente a un PSOE fortalecido desde la Moncloa https://www.lavanguardia.com/politica/20200210/473424151270/feijoo-reune-gobierno-elecciones-galicia.html es La Vanguardia 14 February 2020
The 2009 Basque election was the first one to be held without any major electoral candidacy from the abertzale left, after their previous iterations—the Communist Party of the Basque Homelands (PCTV/EHAK) and Basque Nationalist Action (ANV)—had been outlawed in September 2008 because of their reported ties to ETA and the outlawed Batasuna party.16 September 2008 El Supremo ilegaliza ANV y acuerda su disolución https://elpais.com/elpais/2008/09/16/actualidad/1221553022_850215.html es El País 12 February 202018 September 2008 El Tribunal Supremo acuerda la ilegalización del EHAK-PCTV https://cadenaser.com/ser/2008/09/18/espana/1221695423_850215.html es Cadena SER 12 February 2020 In early February 2009, two political groupings formed by abertzale left members to contest the election, Demokrazia Hiru Milioi (D3M) and Askatasuna ("Freedom"),25 January 2009 La plataforma abertzale D3M presenta sus candidaturas a las elecciones vascas http://www.rtve.es/noticias/20090125/plataforma-abertzale-d3m-presenta-candidaturas-elecciones-vascas/224587.shtml es RTVE 12 February 2020 were barred from contesting the election by both the Supreme Court and the Constitutional Court.8 February 2009 El Tribunal Supremo anula las listas de Askatasuna y D3M https://www.elmundo.es/elmundo/2009/02/08/espana/1234131653.html es El Mundo 12 February 202013 February 2009 El Tribunal Constitucional confirma la anulación de las listas de Askatasuna y D3M https://www.elmundo.es/elmundo/2009/02/13/espana/1234479867.html es El Mundo 12 February 202022 May 2009 Los partidos y marcas de la izquierda abertzale ilegalizadas y la fecha en la que dictó la resolución el TC https://www.publico.es/actualidad/partidos-y-marcas-izquierda-abertzale.html es Público 12 February 2020 In response, the abertzale left asked their voters to cast invalid ballots, both in protest to the court rulings and seeking to prevent tactical voting in favour of either Lehendakari Juan José Ibarretxe's Basque Nationalist Party (PNV) or Eusko Alkartasuna (EA).14 February 2009 La izquierda 'abertzale' votará nulo https://elpais.com/diario/2009/02/14/espana/1234566014_850215.html es El País 12 February 2020

Background
The Ibarretxe Plan, a major proposal by Lehendakari Juan José Ibarretxe to reform the 1979 Basque Statute of Autonomy and turn the region into an associated state to Spain as a way to ending the ongoing conflict with the paramilitary ETA group, was brought to a standstill following its parliamentary defeat in a vote in the Congress of Deputies on 1 February 2005 and the subsequent electoral setback of Ibarretxe's coalition in the April 2005 regional election.1 February 2005 El Congreso rechaza de manera rotunda el 'plan Ibarretxe' https://cadenaser.com/ser/2005/02/01/espana/1107219022_850215.html es Cadena SER 13 February 202018 April 2005 Ibarretxe pierde cuatro escaños y su plan soberanista queda condenado al fracaso https://elpais.com/diario/2005/04/18/portada/1113775204_850215.html es El País 13 February 202018 April 2005 El fracaso del 'plan Ibarretxe' https://cincodias.elpais.com/cincodias/2005/04/18/economia/1113936947_850215.html es Cinco Días 13 February 2020 On 22 March 2006, ETA declared a "permanent ceasefire" to allow for a peace process to ensue with the Spanish government under then-Prime Minister José Luis Rodríguez Zapatero,22 March 2006 ETA declara un alto el fuego permanente https://elpais.com/elpais/2006/03/22/actualidad/1143019019_850215.html es El País 13 February 2020 but peace talks terminated as a result of the 2006 Madrid–Barajas Airport bombing on 30 December.2 January 2007 Reacciones al atentado de ETA contra la T-4 del aeropuerto de Madrid Barajas https://www.elmundo.es/elmundo/2007/01/02/espana/1167757046.html es El Mundo 13 February 2020

Overview
Under the 1979 Statute of Autonomy, the Basque Parliament was the unicameral legislature of the Basque Autonomous Community, having legislative power in devolved matters, as well as the ability to grant or withdraw confidence from a lehendakari.Statute 1979 arts. 25 & 27–28. The electoral and procedural rules were supplemented by national law provisions.LEPV 1990 final prov. 1.
Date
The term of the Basque Parliament expired four years after the date of its previous election, unless it was dissolved earlier. The election decree was required to be issued no later than 25 days before the scheduled expiration date of parliament and published on the following day in the Official Gazette of the Basque Country (BOPV), with election day taking place 54 days after the decree's publication.Statute 1979 art. 26; LEPV 1990 art. 46. The previous election was held on 17 April 2005, which meant that the chamber's term would have expired on 17 April 2009. The election decree was required to be published in the BOPV no later than 24 March 2009, setting the latest possible date for election day on 17 May 2009.
The lehendakari had the prerogative to dissolve the Basque Parliament at any given time and call a snap election, provided that no motion of no confidence was in process.LGV 1981 arts. 7 & 50–51. In the event of an investiture process failing to elect a lehendakari within a 60-day period from the Parliament's reconvening, the chamber was to be automatically dissolved and a fresh election called.LGV 1981 art. 6.
Lehendakari Ibarretxe had been scheduled to announce a snap election for autumn 2008 following his expected failure in holding a referendum on the Basque Country's political status for 25 October 2008, which was averted by the Spanish government.26 April 2008 Ibarretxe anticipará las elecciones si Zapatero recurre su consulta https://elpais.com/diario/2008/04/26/espana/1209160803_850215.html es El País 14 February 202021 May 2008 Zapatero cierra la puerta al 'plan Ibarretxe' y atisba elecciones https://cincodias.elpais.com/cincodias/2008/05/21/economia/1211349382_850215.html es Cinco Días 14 February 202023 May 2008 La estrategia de Ibarretxe para realizar su consulta https://cadenaser.com/ser/2008/05/23/espana/1211500217_850215.html es Cadena SER 14 February 2020 The electoral defeat of the Basque Nationalist Party (PNV) in the 2008 Spanish general election in the region and internal opposition from the PNV leadership to an immediate election delayed the scheduled snap vote to early 2009.5 May 2008 El posible adelanto electoral amenaza cuatro proyectos de ley claves del Gobierno vasco https://www.elcorreo.com/vizcaya/20080505/politica/posible-adelanto-electoral-amenaza-20080505.html es El Correo 14 February 20201 September 2008 Tiempo de descuento electoral https://elpais.com/diario/2008/09/01/paisvasco/1220298001_850215.html es El País 14 February 2020 Finally on 3 January 2009, Ibarretxe took advantage of Galician president Emilio Pérez Touriño's previous announcement of a Galician election for 1 March to call the Basque election simultaneously, a move which was interpreted by the media and by political parties as intending to caught his political rivals by surprise (particularly, the Spanish Socialist Workers' Party (PSOE) and the People's Party (PP), by forcing them to run two simultaneous election campaigns).18 December 2008 Touriño convoca las elecciones para el 1 de marzo https://www.lavozdegalicia.es/noticia/galicia/2008/12/18/tourino-convoca-elecciones-1-marzo/00031229590863369925964.htm es La Voz de Galicia 14 February 20203 January 2009 Aires de agotamiento https://elpais.com/diario/2009/01/03/espana/1230937203_850215.html es El País 14 February 2020
The Basque Parliament was officially dissolved on 6 January 2009 with the publication of the corresponding decree in the BOPV, setting election day for 1 March.Decree 1/2009 2009 art. 1.
Electoral system
Voting for the Parliament was based on universal suffrage, comprising all Spanish nationals over 18 years of age, registered in the Basque Country and with full political rights, provided that they had not been deprived of the right to vote by a final sentence, nor were legally incapacitated.Statute 1979 art. 26; LEPV 1990 arts. 2–3 (suppl. supplemented by LOREG 1985 art. 42).
The Basque Parliament had 75 seats. All were elected in three multi-member constituencies—corresponding to the provinces of Álava, Biscay and Guipúzcoa, each of which was assigned a fixed number of 25 seats to provide for an equal parliamentary representation of the three provinces—using the D'Hondt method and closed-list proportional voting, with a three percent-threshold of valid votes (including blank ballots) in each constituency.Statute 1979 art. 26; LEPV 1990 arts. 9–12; Decree 1/2009 2009 art. 2. The use of this electoral method resulted in a higher effective threshold depending on district magnitude and vote distribution.Gallagher Michael 30 July 2012 http://www.tcd.ie/Political_Science/staff/michael_gallagher/ElSystems/Docts/effthresh.php Effective threshold in electoral systems Trinity College Dublin Dublin https://web.archive.org/web/20170730092518/http://www.tcd.ie/Political_Science/staff/michael_gallagher/ElSystems/Docts/effthresh.php 22 July 2017 30 July 2017
The law did not provide for by-elections to fill vacant seats; instead, any vacancies arising after the proclamation of candidates and during the legislative term were filled by the next candidates on the party lists or, when required, by designated substitutes.LEPV 1990 arts. 12 & 65 (suppl. supplemented by LOREG 1985 arts. 46 & 48).

Parties and candidates
The electoral law allowed for parties and federations registered in the interior ministry, alliances and groupings of electors to present lists of candidates. Parties and federations intending to form an alliance were required to inform the relevant electoral commission within 10 days of the election call, whereas groupings of electors needed to secure the signature of at least one percent of the electorate in the constituencies for which they sought election, disallowing electors from signing for more than one list.LEPV 1990 art. 53 (suppl. supplemented by LOREG 1985 art. 44). Amendments in 2007 required a balanced composition of men and women in the electoral lists, so that candidates of either sex made up at least 40 percent of the total composition.LOREG 1985 art. 44 bis.

Opinion polls
The tables below list opinion polling results in reverse chronological order, showing the most recent first and using the dates when the survey fieldwork was done, as opposed to the date of publication. Where the fieldwork dates are unknown, the date of publication is given instead. The highest percentage figure in each polling survey is displayed with its background shaded in the leading party's colour. If a tie ensues, this is applied to the figures with the highest percentages. The "Lead" column on the right shows the percentage-point difference between the parties with the highest percentages in a poll.
Voting intention estimates
The table below lists weighted voting intention estimates. Refusals are generally excluded from the party vote percentages, while question wording and the treatment of "don't know" responses and those not intending to vote may vary between polling organisations. When available, seat projections determined by the polling organisations are displayed below (or in place of) the percentages in a smaller font; 38 seats were required for an absolute majority in the Basque Parliament.

Aftermath
Invalid votes
After Demokrazia Hiru Milioi (D3M) and Askatasuna ("Freedom") were outlawed in February 2009, Basque separatists were asked to cast their vote for D3M, whose ballots would be counted as invalid. According to some sources, the pro-independence Basque left (that were formerly represented by Batasuna and later by EHAK) was surprised by the lower support of their void option. If the void votes are to be counted as the support of this option, it would have obtained the worst results in their history, having received 100,924 void votes, 50,000 less than in the previous regional election and less than half their historical top in the 1998 election.Source: Basque Government electoral results record http://www9.euskadi.net/emaitzak/indice_i.htm Archived copy 2009-04-01 dead https://web.archive.org/web/20081010114000/http://www.euskadi.net/emaitzak/indice_i.htm 2008-10-10 http://www9.euskadi.net/emaitzak/indice_c.htm Archived copy 2009-04-01 dead https://web.archive.org/web/20090203091046/http://www9.euskadi.net/emaitzak/indice_c.htm 2009-02-03 es http://www9.euskadi.net/emaitzak/indice_e.htm Archived copy 2009-04-01 dead https://web.archive.org/web/20090305073558/http://www9.euskadi.net/emaitzak/indice_e.htm 2009-03-05 eu
Major electoral analysis has been performed on the results and the issue of the void votes by pro-Basque nationalist and non-Basque nationalist parties alike. It is a frequent misunderstanding that, had the votes for the illegal lists been counted as valid, they would have been entitled to seven seats.Público.es: D3M habría logrado siete escaños https://web.archive.org/web/20090306102314/http://www.publico.es/espana/205500/d/m/logrado/siete/escanos March 6, 2009 es Actually, taking into account that the average of "normal" void votes (struck-out names, double-voting, etc.) in the last three Basque regional elections (1998, 2001 and 2005) was about 0.4%, and assuming that all the void votes that could not be accounted for by that statistic alone were cast for a hypothetical unitary abertzale list (instead of for two different lists, Askatasuna and D3M), those ~97,000 votes would have accounted for at most 6 seats. The discrepancy can be understood in terms of the seat allocation method used (the D'Hondt method) and, most importantly, the fact that seats are independently assigned in three 25-seat constituencies. Thus, a party can lose up to three seats by losing a single vote in each constituency.
Government formation
